ELIGIBILITY: All applicable federal, state and local laws apply. The Notre Dame WebPack Sweepstakes is open to only to existing Notre Dame WebPack members who are legal residents of the United States (excluding Puerto Rico, Guam, and the U.S. Virgin Islands) who are 18 years of age at time of entry. Employees of College Sports TV, University of Notre Dame, VSI (the “Notre Dame Online Provider”), their respective parents, subsidiaries, affiliates, directors, officers, share holders, governors, employees, and agents, as well as their respective spouses, children, siblings and all others residing in the same household as such employees, are not eligible to participate. Void where prohibited or restricted by law.

The Notre Dame WebPack Sweepstakes begins at 12:00 A.M. PST on October 14th, 2005 and ends at 11:59 P.M. PST on December 15th, 2005. Limit one entry per e-mail address or WebPack account.

1. AGREEMENT TO OFFICIAL RULES: By participating in this sweepstakes, each entrant agrees to accept and to abide by these Official Rules. The decisions of the judges are final and binding as they pertain to this sweepstakes.

2. HOW TO ENTER: Simply log on to http://www.myund.com and sign up for any Notre Dame WebPack product. Fill out the online registration form in its entirety. Process does constitute entry into the Sweepstakes and is subject to these Official Rules. Online registrations for the Sweepstakes will be accepted between 12:00 A.M. PST on 10/14/05 and 12:01 A.M. PST on 12/15/05. Entry is deemed submitted by the authorized account holder of the e-mail address submitted at time of entry. Authorized account holder is defined as the natural person who is assigned to the e-mail address by Notre Dame Online Provider. Entrant's Notre Dame WebPack account must be active, current and in good standing as of 12/16/05, in order to redeem Sweepstakes prizes. Notre Dame Online Provider assumes no responsibility for the computer system, hardware, software, network program, or other errors, failures, or malfunctions of any kind, whether human or technical in nature, in transmission or receipt of entries. By entering this Sweepstakes, entrants give their expressed permission to be contacted by Notre Dame Online Provider via e-mail, telephone and/or postal mail. Submission of an entry constitutes your acceptance of these Official Rules as the terms and conditions governing this contest. Submission of an entry grants Notre Dame Online Provider and their agents the right to publish, use, adapt, sell, edit and/or modify such entry in any way, in commerce, and in any way worldwide, including but not limited to the Internet, without limitation, and without compensation to entrants.

3. LIMITATIONS OF LIABILITY: Notre Dame Online Provider and their agents are not responsible for lost, damaged, misdirected, illegible, or incomplete entries, or for any computer, online, telephone or technical malfunctions, delays, or human errors that occur in the processing, transmission or receipt of entries or for inaccurate transcription of entry information or for entries that are stolen, misdirected, garbled, lost or delayed by computer transmissions. If, for any reason the Sweepstakes is not capable of being conducted as planned including but not limited to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond control of Notre Dame Online Provider. Notre Dame Online Provider reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes.

4. DETERMINATION OF WINNERS: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SWEEPSTAKES JUDGES, WHOSE DECISIONS ARE FINAL. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL THE ENTRANT'S ELIGIBILTY HAS BEEN VERIFIED, THE ENTRANT'S SHIPPING VERIFICATION HAS BEEN CONFIRMED AND THAT VERIFICATION IS COMPLETE. Winners will be selected at random from the total active database of Notre Dame WebPack members. All potential winners must comply with the terms and conditions of these Official Rules. Winning is contingent upon fulfilling all requirements. Limit one (1) prize per person. Sweepstakes entrants will be notified of their winning selection via their Notre Dame WebPack e-mail account. The potential winner of any prize may be asked to complete, sign and return an Affidavit of Eligibility and Liability/Publicity Release within seven days, consenting to the publication of his/her name in any media for any promotional purpose, without limitation or further compensation. If a potential winner cannot be contacted, or if he/she fails to sign and return the Affidavit of Eligibility and Liability/Publicity Release within the required time period or if notices are returned as undeliverable, one of the 5 runner-up prize winners will be awarded the 1st prize and must adhere to the same conditions. An additional runner-up winner will be then selected. If any of prizes remain unclaimed or not awarded during the Sweepstakes, a random drawing to award that prize will take place within 30 days after the conclusion of the Sweepstakes Period or after determination that a potential winner has been disqualified for any reason. All prizes will be awarded, provided a minimum of 100 Notre Dame WebPack registrations are received.

5. PRIZES:

1st Prize: Two (2) tickets to any 2006 NCAA or NFL Championship Bowl Game of the winner’s choosing- depending on ticket availability to selected event. In-stadium location and purchase price of tickets for the game selected by the winner is at that sole discretion of the Sweepstakes Judges.

Runner-up Prizes: Five (5) Runner-up Winners will be awarded one (1) football jersey, autographed by Notre Dame Alumni, Tim Brown.

For all prizes: No cash or other substitution, assignment or transfer of prizes permitted, except by Sweepstakes Judges, who reserve the right to substitute a prize or prize component with another of comparable or greater value. Winners are solely responsible for all taxes and fees and/or shipping fees associated with prize receipt and/or use, and prizes will only be shipped within the 50 United States (and D.C.). TOTAL ARV OF ALL PRIZES: $4,000 USD.

6. RELEASE: By submitting an entry and/or accepting prizes, entrants/winners agree to release Notre Dame Online Services Provider and its subsidiaries, affiliates, and related companies and each of their respective officers, directors, employees, and agents, including but not limited to Notre Dame Online Provider, Seepstake Judges,, CSTV, or VSI from any and all liability, loss, or damage incurred with respect to the contest, including but not limited to the use of submissions and the awarding, receipt, possession and/or misuse of any prize. Entrants acknowledge that said Notre Dame Online Services Provider has neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee expressed or implied, in fact or in law, relative to the Sweepstakes and any prize including but not limited to its quality, mechanical condition or fitness for particular purpose.

7. DISPUTES: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than the administration of the Promotion or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the state of California in the U.S.; (ii) any and all claims, judgments and awards shall be limited to actual prize in dispute but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses of the prize in dispute, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California U.S.A.
